David’s practice focuses on defending construction defect, product liability, and professional liability claims. David’s professional liability practice focuses on defending real estate brokers, home inspectors, and other real estate professionals in actions relating to the sale of property. These claims often allege fraud and seek punitive damages for failure to disclose or other conduct which caused the buyer to seek legal recourse.
On the construction side, David represents major developers, architects, engineers, general contractors and subcontractors in complex commercial and residential developments, including OCIP and CCIP projects. David defends and prosecutes contractual indemnity claims and he has defended product manufacturers and materials suppliers against claims of defective and/or contaminated products.
David also has an active transactional and business litigation practice and defends companies in actions prosecuted by the California Attorney General, Contractors State License Board, and other administrative entities. David guides the client through the administrative process with an emphasis on preventing license revocation and/or suspension.
Clients also consult with David on risk avoidance and risk management strategies.
David is admitted to practice in all California and Texas state courts and the U.S. District Court for the Eastern District of California. In his free time, David provides legal counseling to members of the community as a volunteer for the Benicia Lawyers in the Library Program. He resides in the Clayton Valley with his wife and two young sons.
