VLA&S attorney Jennifer Thomas defends Optometrist client against claims brought by the California Attorney General alleging that based on the symptoms with which patient presented, our client’s failure to dilate and examine the patient’s eye to rule-out retinal detachment (a time-critical eye emergency) represented gross negligent.  Following a three-day hearing  which included lengthy testimony from Optometry experts on both sides, the Judge ruled that our client met his standard of care by: collecting pertinent information RE the patient’s condition; evaluating patient’s symptoms and the signs he observed; and, reaching a clinically reasonable diagnosis.

The Judge ordered the Accusation dismissed and denied the State’s demand for costs and the Board of Optometry has adopted the ruling and dismissed the Accusation.
